In new courtroom paperwork obtained by TMZ … Alex Spiro, the lawyer representing the rap mogul, says he is gearing as much as file a movement to dismiss the lawsuit towards Jay-Z … claiming the statute “Jane Doe” is suing underneath did not even take impact till after the alleged sexual assault … and cannot be utilized towards the rapper retroactively.
As Jay-Z’s legal professional places it … the statute was enacted in December 2000 — 3 months after Jane Doe claimed she was sexually assaulted by Jay-Z and Diddy at an MTV Video Music Awards after-party.
Even when the statute did apply, Jay-Z’s lawyer says it solely covers conduct dedicated inside New York Metropolis … and he insists the purported location of the alleged assault couldn’t have been NYC.
He says Jane Doe claimed in her criticism she was pushed from Radio Metropolis Music Corridor to a “large, white residence with a gated U-shaped driveway” about 20 minutes away … however Jay-Z’s lawyer says any residence with that description — if it existed on the time — can be outdoors the territorial boundaries of NYC.
